HOW TO IMPLEMENT A STOP WORK

The ANMF (Vic Branch) protected industrial action ballot of members authorises single and/or consecutive work stoppages of up to four hours duration including such stoppages to travel for and to attend stop-work meetings.

How do ANMF members operationalise the scheduled stop-work on 20 November safely?

Wards will need to maintain at least night duty staffing levels during the period of the stop work action between 12.45pm – 4.15pm.  We have advised Healthscope that each ward/unit will ensure that night staffing levels will be maintained, and while it is the primary responsibility of your employer to ensure systems of work will provide safe patient care, members should also exercise their clinical judgement on the day of the stop work action to ensure patient safety.

Healthscope perioperative members may participate in stop work action from 12:45 – 4:15pm, ensuring sufficient staff for emergency procedures remain.  This may mean a delay to the start of the afternoon theatre list, as agreed in your campus theatres.  ANMF members should liaise with each other and their ANMF Job Rep to organise the stop work action within your workplace.

If you’re on a 10-hour or 12-hour shift – you may commence your stop-work action at 12:45 and conclude it at 4:15pm by returning on shift.

If my shift ends before 4:15pm, do I need to return to work?

No.  If you are rostered on the AM shift for example, you may stop work at 12:45pm and attend the rally.  There is no requirement to return to work.

Should I let my manager know that I am taking stop work protected industrial action?

Please note that you are not legally required to advise your manager of your participation in the stop work. You can, as a matter of courtesy let them know, and that is usually done in the public sector on the day before or morning of the stop work. Healthscope have had five (5) clear business days’ notice of the intention to take stop work action and they know approximately how many union members there are across the 12 workplaces. They can prepare for the stop work.

We have advised Healthscope that each ward/unit will ensure that night staffing levels will be maintained.  Please speak with your ANMF Job Rep or consult your ANMF Organiser but please note you are not obliged to disclose whether or not you are going to engage in the stop work protected industrial action.

What about the other industrial action – can I keep taking that action?

Yes, all previously notified protected industrial action can continue.  This includes wearing your red t-shirt, talking to patients, doctors, families and the media (including social media) about the campaign, refusing redeployment, refusing overtime and the data/admin bans.

Who can attend?

Speak with your colleagues and ensure that your ward or unit is represented at the stop work meeting/rally. Leave night staffing levels for the period of the stop work to ensure patient safety. If you are in doubt, speak with your ANMF Job Rep or urgently seek ANMF advice.

Who manages staffing numbers for the time of the stop work meeting/rally?

Managers are responsible for adequate staffing. This may mean that Healthscope need to plan for having less staff available.

What happens if my manager says I can’t attend the stop work?

Contact the ANMF straight away and let us know so that we can assist.

If I’m not rostered at the time of the stop work, can I attend?

Yes, members who are on leave or have the day off are encouraged to attend.

Do I need to bring anything to the rally?

Wear your red t-shirt and if you’re crafty bring a handmade placard that lets the community (and media) know what ANMF members are fighting for.

CAN THE ANMF HELP IF I EXPERIENCE FINANCIAL HARDSHIP AS A RESULT OF PAY DOCKING?

Yes. The ANMF operates a member Hardship Fund for those involved in protected industrial action. Importantly, this is not an income replacement fund, it may provide some support to members who face significant hardship as a result of the protected industrial action where eligible. Members who are experiencing demonstrated financial hardship and have evidence of pay docking can apply at anmfvic.asn.au/healthscopehardship

THREATS OR HARRASSMENT

It is your right under the Fair Work Act to take the forms of protected industrial including work stoppages. ‘Protected’ means you cannot be dismissed or disciplined for taking these actions.
